Doesn't Reg 9 give certain windows that they have to give him up, and I think that the next tests are outside these windows?

I'm unsure. I'm fine if that's the case but it never seems clear.

World Rugby Regulation 9.7

There are two Hemisphere Release Periods.

(c) Rugby Championship Release Period

(ii) Unless Council approves otherwise the Rugby Championship Release Period shall operate each year for an eight week period. It shall ordinarily commence on or around the second weekend in August and shall conclude on or around the first weekend in October each year

9.34 (b) Where the Right to Release for Matches is exercised for Players pursuant to the Rugby Championship Release Period and such Players are contracted to Rugby Bodies or Clubs in the northern hemisphere then the exercise of the Right to Release pursuant to this Regulation 9 may be exercised for eight weeks out of the eight week period.

I imagine that there is a bit of give and take both ways. With the RWC coming up I am sure Joe is laying the groundwork for there to be good co-operation in the lead up.
Now with the Giteau Law buried those OS clubs that contract Australian players should know that they may be called on in the test windows. With Skelton he was not expecting to be picked.
Skelton likely needs a break and we will see him on the EOYT.
