Well that was my point although I didn’t explicitly write it. This is a get out of my contract with pay; free card. If you remember, the early rumours were Folau did this get out of his long term RA contract and get paid for it.

I'm not really sure what your point is here. It's generally pretty obvious if an employee is damaging the reputation of the employer. You then need to make it stop or if it's irreconcilable you terminate their employment.

No part of this suggests that terminating the employment doesn't come at a cost to pay them out.

The concept that this sets some sort of precedent that the next time an employee does this they will be allowed to just continue doing it regardless of the impact it causes it is complete fantasy.


Standard rule, if someone maybe required to be defend in court the company's "core values", don't let the HR department write it, and get it vetted by your legal team

The challenge is what the f*ck doesn't fit under "undermining the commercial interests of a sponsor/employer" where those "core values" are nebulously documented at a some weekend management retreat facilitated by someone from HR

And subject to regular review as HR personnel come and go bringing the latest fads along with them.

I don't really see what HR has to do with this.

We're talking about a situation where there is a complete breakdown in the relationship and the employer has lost control of the employee who is actively damaging the public reputation of the employer.

Fatprop seems to be insinuating a situation where the employer and employee are otherwise enjoying a good working relationship and HR is saying that they've got to be fired because they breached a policy that they came up with.

I'm trying to figure out if the new prop Tauakipulu is Aus eligible. Are the rules for U18s the same as U20s, sevens and test eligibility (i.e. five year residency, birth or parentage)? If so does his brother qualify via Aus parentage? Otherwise he'll have to wait til he's 23 to represent Australia. The Tahs haven't had a foreign development player for while, as far as I recall.


He went Springfield HS then IGS before heading over to NZ to finish school. Not sure if he was born here.

Fatprop, it depends very much on what the post said, and what happened next. Let's take your Glencore example. If a player posts 'I believe coal mining is damaging the planet, and would like the government to put a moratorium on new mines' would be regarded very differently to 'Burning coal is killing people, coal miners are effectively murderers and should be jailed'

Secondly, if the player who made the second statement was counselled, and told that accusing people going about their quite legal daily work of a serious criminal offence was not acceptable, and to do so again could result in possible termination, the counselling was recorded in writing and signed by the offending player to the effect that he had received this warning, then yes, should he re-offend he may be terminated.

I would think the player who made the first statement would be just reminded that Glencore were paying his wages, he is free to have his beliefs, but just keep his posts civil and respectful of all concerned.
