Byrnes spared fine over attack

Melbourne Rebels second-rower Adam Byrnes has escaped a $5000 fine for launching a verbal attack on Waratahs centre Tom Carter in March.
Byrnes must still pay $2500 in costs to SANZAR but had the original $5000 penalty for calling Carter a ''disgrace'' quashed on appeal.
The protracted stoush began when Carter accused Byrnes of ''eye-gouging'' him during the teams's round two Super Rugby match at Melbourne's AAMI Park. Byrnes was found not guilty of foul play on appeal but was fined $7500 two months later for making a ''sustained and serious verbal attack'' on Carter after talking about the impact of the incident to a Sydney newspaper.
He appealed the decision and must now pay the costs portion to SANZAR within the week.
Meanwhile, Wallabies star James O'Connor has recovered from liver damage but is battling a hamstring injury ahead of the Rebels' clash with Super Rugby champions Queensland Reds on June 29 in Melbourne.
O'Connor was given the green light from his specialist to resume contact training with scans confirming his lacerated liver, suffered last month playing against the Waratahs, had healed well.

I'd love to hear a bit more detail on why the appeal was allowed. Anyone got any more info? I wonder if the "you can't prove I said that" defence is what got him over the line.

He shouldn't have said what he did, but maybe neither should have Carter.

Carter followed due process, his eye was injured while Byrnes was holding his head, he told the ref who reported the incident. He didn't take a swing at the guy or take matters into his own hands, he followed the laws of the game as he felt Byrnes had caused him an injury. A no time did he actually go after Byrnes publicly or in any fashion other than by the laws of the game they both play. I still feel Byrnes is disgraceful for the way he went about his retaliation outside of that system.


Interesting that he is still paying costs, does that mean that while the fine is overturned that e is still guilty?

No. My understanding is that they are two separate issues. Usually you'd think if the appeal was successful he wouldn't have to pay costs but the story I read suggested there was something unique about the appeal that meant that he'd still pay the costs.

PS. I had originally assumed that Byrnes had been cleared on appeal (i.e. the guilty verdict had been overturned). Re-reading the media stories more carefully, it may simply be that his penalty was quashed. All seems a bit strange.

Sure you would be pissed if you didn't do something you were accused of. The point is though, Carter didn't go on a rant about it, he told the ref that he had been racked across the eyes. Intent or not is up the board to decide. Byrnes showed his class by his outburst, it was Immature and childish.
