Just how long does a prior incident count you? I was just thinking, in the case of Ioane, 4 years seems a long time in a rugby career to carry an extra penalty

I would think in the case of foul play it should never go away. Why should anybody guilty of things like gouging, continual head high tackles, shoulder charges etc have those things expunged?

It seems to be completely random and at the discression of the disciplinary panel. Dylan Hartley was able to get them to ignore his previous record including a 6 month ban for eye gouging. Rowntree gave a sob story to the panel about how he was a changed man etc. and there was similar testimony from Mallinder.

So it seems how long it counts depends on how good those advocating for the player are and how soft hearted/easy to manipulate the members of the panel are.

To me it makes no sense to do it that way. It should be codified so that judgements are easily understandable. There should be a cut off period for players records (according to the severity of the offence). The player should then be on probation for X number of years after. If he doesn't recieve a ban during his probationary period it should be ignored at future hearings. If he does then there should be a knock on effect both to his ban and to his next probationary period. Certain very serious offences should have a lifetime probationary period.

I'm sure one day the IRB will get around to cleaning up the disciplinary process, but I wouldn't hold my breath waiting on them.

I haven't watched league to any great degree since they kicked out my side (the Blue Bags) in 1983, but they have one thing spot on. The judicial system. A player knows what they are in for right from the start. None of this legal horse play bullshit we see with the massive inconsistancies that only lawyers will tell you takes into account the intracies of each situation. Sorry to tell you fellas such inconsistancies do nothing but degrade the whole system and bring it into contempt ala SAZAR judiciary.

Let's see if I read you right. You're suggesting that they set a probationary period with every conviction. That sounds like a very sensible idea.

Yep. Fixed penalties with a sliding scale of increasing for each new instance. For instance a second conviction for act act of Gross Premediatated foul play like gouging would attrack a life ban from the game at all levels.

Spear Tackles/Lifting tackles 1) 2 matches (no byes) first offence 2) 2nd Offence 4 matches 3) third offence 12 weeks on so forth. Just as examples forget the number I am just trying to show the mechanics of how I think it should work in Rugby.

As with league once cited you can defend or plead with a discount. No discount if your defend and are found guilty, set penalty applies. No appeals on penalty.

It is stupid that your demerite points on the road can be reinstated before your on field priors can be. In the case of Digby I think it is wrong. He plays the game hard but he doesn't play it foul.
