"If they don't nominate an amateur club" is the key part there, they can't be blocked from nominating one just so they can then be directed to one via a draft or some other means. There is no mechanism available for the super rugby sides or the state unions to redirect professional players who have already declared their club.This only applies to Super Rugby teams, due to them being employers.
If pro players don't nominate an amateur club, the CBA allows the state union to direct them to play for whichever club the union decides.

The issue is if the get knocked out in the finals in one of the grades then they find themselves ineligible for a lower grade in the finals because they have played most of the season in a higher grade. So they could well find themselves sitting on the hill for GF day.These boys might start a trend drawing players away from brothers if they have some success. Playing prem grade sounds a whole lot better then being around reserve/3rd grade at brothers after their reds contingent parachute in at the end of the year.
